Deputy IGP: Why Anwar not given copy of police report
KUALA LUMPUR:
The police will give Datuk Seri Anwar Ibrahim a copy of the police report lodged by his former aide alleging that Anwar had sodomised him “if and when” Anwar is charged in court.
Deputy Inspector-General of Police Tan Sri Ismail Omar said police could not give him a copy now as investigations were still in progress.“Whatever we do is strictly in accordance with the law.
Section 51A of the Criminal Procedure Code (CPC) clearly stipulates that.“There have been so many allegations and accusations hurled against us in this and other matters, but as far as we are concerned, we will continue to be professional in our approach and carry out our duties according to the law,” he said.
Section 51A of the CPC, titled Delivery of certain documents, reads as follows.
(1) The prosecution shall before the commencement of the trial deliver to the accused the following documents:
(a) A copy of the information made under Section 107 relating to the commission of the offence to which the accused is charged, if any;
(b) A copy of any document which would be tendered as part of the evidence for the prosecution; and
(c) A written statement of facts favourable to the defence of the accused signed under the hand of the Public Prosecutor or any person conducting the prosecution.
(2) Notwithstanding paragraph (c), the prosecution may not supply any fact favourable to the accused if its supply would be contrary to public interest.
On Thursday, Anwar lashed out at the police, saying that they had not given him a copy of the police report of the sodomy allegation made by his accuser Mohd Saiful Bukhari Azlan.
He questioned why, despite repeated requests, the report was being kept from him and his lawyers.
“Is it so that they can keep amending and amending and amending it to fit in with the statement that I have just given to them?
“If they give the report to me now, how am I supposed to know that it is the original? Are they waiting to make up the ‘perfect’ police report?” he asked, adding that each time he sought a copy, the police said they had been instructed against giving him the report.
The Deputy IGP rubbished as baseless and unfounded Anwar’s allegation that police would fabricate evidence against him using his DNA, as he claimed they had done 10 years ago.
He added that Anwar should be more responsible about making such statements or allegations.
kzso - whether anwar is not clever or his lawyers are not clever (do no want to say stupid because they're 'learned' people). they know that this case is still under investigation and the police can't give the report until it is proven there is a case or otherwise ie "before the commencement of the trial".it will give a report until there is formal charge against anwar. anwar and his lawyers are tempting to manipulate and asking the police to be professional but when the police are doing so they said it's the police who are manipulating or there's a conspiracy against anwar. anwar is panicking and talked too much. the police are now experienced with anwar antics and it's good that the deputy igp reply anwar's and his learned lawyers with facts and figures by mentioning the relevant sections.
